Divorce through the Civil Registry Office / Civil Registry Office in Ukraine

What is the order of divorce through the registry office / registry office in Ukraine

Divorce through the registry office, according to the current legislation in the field of family law, is possible in the following bodies:

  • In the registry office
  • In the courts.

The easiest, fastest and not requiring significant material costs way to obtain a divorce in Ukraine without resorting to resolving the issue through the court is its registration through the Civil Registry Office / Civil Registry Office.

In modern realities, divorce through the registry office is possible in such cases:

  • the husband and wife have a common desire for divorce (mutual divorce);
  • a couple who get divorced without children;

It should be noted that children under the age of 18 must be shared by the couple.

To file for divorce at the Civil Registry Office / Civil Registry Office, a married couple must submit a common application for them to the registry office at the place of residence of one of the couple.

The registry office cannot refuse to accept a mutual application for divorce due to the fact that the application was sent to the place of residence of the second spouse.

The mutual application for divorce in the Civil Registry Office / Civil Registry Office is filled out according to the established model and consists of two parts, which are filled in by each of the couple, respectively.

The husband and wife must fill their share.

After submitting all the necessary documents, the registry office announces the day on which the marriage will be dissolved in accordance with the established deadlines at the legislative level.

After a month has passed, the spouses need to come to the registry office / civil registry office to register a divorce, as well as receive a divorce certificate.

It is important to note that if there are disagreements between a husband and wife regarding property, this does not affect the ability to file a divorce at the registry office / civil registry office.

If a couple has a dispute over property, the spouses can independently apply to the courts, having with them the relevant statement regarding the division of property.

You can dissolve the marriage through the registry office in this case.

What documents are needed for a divorce through the Civil Registry Office / Civil Registry Office in Ukraine

What list of documents should spouses prepare for divorce? The approved list of documents includes:

  • passports of a married couple;
  • original marriage certificate;
  • a receipt confirming that the state fee has been paid;
  • jointly completed application by mutual agreement.

All documents are submitted in original, copies are not required. The signatures put by the husband and wife on the application indicate mutual consent to divorce. Spouses are required to be present at the time of application together.

Divorce through the Civil Registry Office / Civil Registry Office without the presence of one of the spouses in Ukraine

In practice, difficulties often arise due to the fact that someone from the family cannot be at the registry office / civil registry office during the filing for divorce. For such cases, the law provides for the right of one of the couples to fill out their part of the joint application for divorce, notarize it, and then transfer it to the second spouse.

At the moment when the husband / wife will independently transfer the documents for divorce to the Civil Registry Office / Civil Registry Office, along with a personally filled out application, it is necessary to provide a notarized statement and a power of attorney for filing an application by the second of the married couple, who could not independently attend the Civil Registry Office / Civil Registry Office. That is, the application will be submitted without the presence of the second of the married couple.

If the second spouse is not at the registration of a divorce, the application must indicate that the second of the couple agrees to divorce without his presence. You should also decide with the Civil Registry Office / Civil Registry Office where the divorce certificate will be sent after its state registration is made.

In addition, modern legislation provides for cases when a divorce is possible in the registry office at the request of only one of the couple in the event that the second of the couple:

These issues are resolved only by the court in a separate proceeding.

To obtain a unilateral divorce, you need to have an appropriate court decision regarding the recognition of the second spouse as missing or incapacitated. In this case, at the time of filing such an application, the court decision must enter into its legal force.

How much does it cost to dissolve a marriage at a registry office in Ukraine?

How much will it cost to dissolve the marriage at the registry office? The cost corresponds to the size of the state duty. Today the state duty is 8 UAH 50 kopecks.
If you need to file a divorce without the presence of one of the married couple, then additional costs will be for notarization of the application and issuing a power of attorney.

Divorce online in the registry office / registry office in Ukraine

It is possible to use the online divorce service after registering on the web portal of the Ministry of Justice of Ukraine “Application in the field of state registration of acts of civil status” and submit a general application for divorce. After registration, all online services will be available with instructions for users.

After filling in all the personal data, the spouses will be faced with the need to sign such an application with an electronic digital signature.

If someone from the pair does not have an electronic signature, you need to contact the registry office / civil registry office within 3 working days and sign it yourself.

A mutual application for divorce is accepted from the date of the signing by the husband and wife.

For such a divorce, the originals of the passports of each of the couple are required, as well as their marriage certificate.

Thus, the procedure for online divorce is as follows:

  • registration on the web portal of the Ministry of Justice;
  • filling out and submitting an application;
  • affixing an electronic signature (or in the registry office);

In general, the idea of an electronic format for filing an application for divorce by mutual agreement is quite convenient for citizens who cannot come to the registry office / civil registry office in person.

However, in practice, it is not popular due to the fact that spouses do not always have the opportunity to use a digital electronic signature.

In addition, the web portal has a lot of flaws that complicate the procedure for applying to the state authority, and sometimes delay the consideration of an application for divorce by mutual consent.

Summing up, it should be added that if you have difficulties when registering a divorce process in the registry office / civil registry office, you can contact a lawyer with many years of experience in divorce, Alexei Nikolayevich Skriabin, who will provide you with legal advice on issues of interest to you, as well as will help to quickly dissolve the marriage through the Civil Registry Office / Civil Registry Office.

Putin says Russian has the right to take military action over Ukraine

Published: 11:32 GMT, 21 December 2021 | Updated: 17:10 GMT, 21 December 2021

  • Vladimir Putin has warned he is willing to take 'military measures' in response to 'unfriendly' Western action in Ukraine, in the clearest sign yet that the Russian strongman is gearing up for war.
  • Putin, speaking during a meeting at the defence ministry on Tuesday, said Russia will 'react toughly to unfriendly steps' and stressed 'that we have every right to do so.'
  • America has been warning for weeks that Putin appears to be readying tens of thousands of troops, tanks and artillery pieces to invade Ukraine, but Putin has insisted it is merely a defence force — until now.
  • He spoke just days after Russia issued a list of demands to NATO, including that Ukraine never be allowed to join the alliance and that its forces be withdrawn from former Soviet states.
  • Dmitry Kiselyov, a media mogul known as Putin's mouthpiece, yesterday threatened to 'put a gun to America's head' if NATO forces are stationed in Ukraine and warned the alliance to back off 'otherwise, everyone will be turned into radioactive ash.'

Vladimir Putin has threatened to take 'military measures' in response to 'unfriendly' Western actions around Ukraine (pictured, Russian forces currently massed in border regions)

Russian paratroopers take part in training exercises near Moscow in footage released Tuesday amid fears they could be used to invade eastern Ukraine

Putin said Russia would be 'within our rights' to take military measures in Ukraine

  1. 'We need long-term legally binding guarantees,' Putin told the meeting on Tuesday, even as he warned against taking America at its word.
  2. 'The United States easily withdraws from all international treaties that for one reason or another become uninteresting to them,' he added.
  3. 'What is going on, this tension that builds up in Europe, it is their fault, At each step Russia had to respond somehow.

'At each step the situation got worse and worse, degraded and degraded. And today we are in the situation when we need to decide something.'

Russia 'cannot allow' the West to put its weapons so close to Moscow, he added.

'If this infrastructure moves, if the US and NATO missile systems appear in Ukraine, then their flight time to Moscow will be reduced to 7-10 minutes, and with the deployment of hypersonic weapons — to five,' he said.

  • The US and UK have dispatched cybersecurity teams to Ukraine in secret to prepare for Russian attacks on the country's computer networks.
  • Washington fears Putin will use cyber warfare as the first stage in what may become a full-blown invasion of the country, by turning off power grids or shutting down the banking system.
  • Russian hackers have already successfully attacked Ukraine's power grid — once in 2015, and again in 2016.
  • American officials told the New York Times that a 'widespread campaign' has been underway for months as hackers target 'Ukrainian government agencies, the national police, and electric utilities.'
  • The aim, the officials say, could be to weaken the country ahead of a ground assault by tens of thousands of Russian troops massed nearby.
  • Or, if the hacking is particularly successful, it could destabilize the government to such an extent that President Volodymyr Zelensky is ousted and replaced by another leader who is more sympathetic to Moscow.

The Kremlin said today that high-level talks between the US and Russia are underway over the list of demands, but said no agreements have yet been reached.

The White House has said it will consult with NATO allies over the demands, but it was willing to make no promises.

Asked about those demands by the BBC on Monday, Mr Kiselyov responded: 'If Ukraine ever joins NATO or if NATO develops military infrastructure there, we will hold a gun to America's head. We have the military capability.'

  1. Russia is 'one hundred per cent' willing to use force to defend its red lines, Mr Kiselyov added, saying that it is a 'matter of life or death' for his country.
  2. He also warned of the risk of a repeat of the Cuban Missile Crisis if NATO deploys missiles in regions where they can quickly strike Moscow.
  3. 'It would be good to harmonise our interests and not put Russia in a position where missiles could reach us in four minutes,' he added.
  4. 'Russia is ready to create a comparable, analogous threat, by deploying its weapons close to decision-making centres.

'But we are suggesting a way of avoiding this, of not creating threats. Otherwise, everyone will be turned into radioactive ash.'

Meanwhile a presenter on another state-owned channel, Rossiya 1, was warning viewers on Monday that 'maybe we really are on the verge of war with NATO.'

The presenter said: 'The United States must sign off on its hegemony; its hegemony is over.'

'Either they step back voluntarily or we'll make them do it by force. And Russia makes no guarantees about the survival of Ukraine, especially as a sovereign state.

  • 'Maybe we really are on the eve of war with NATO.'
  • While top diplomats from both Russia and the US have 'discussed' the Kremlin's demands, Moscow says it has yet to receive a 'substantive' response to them.
  • The White House has said only that it will 'discuss' the list with its allies, but added that Russia cannot be allowed to interfere in the security policy of other nations.
  • Amid the rising tensions, Washington advised all US citizens against travel to Ukraine due to the imminent threat of Russian invasion.
  • The warning was contained within a travel alert issued on Monday that raised the alert level for Ukraine to four — the highest the scale goes.
  • US citizens were warned of the risk 'that Russia is planning for significant military action against Ukraine' and that the security situation in border areas and around Crimea 'could deteriorate with little notice'.

Divorce Rate by Country: The World’s 10 Most and Least Divorced Nations

We’ve taken a closer look at the divorce rate by country across the globe and it appears that overall, marriage is becoming less popular, yet divorce continues to rise. Check out the infographic below:

Divorce Rate by Country

Every year, world organizations such as the UN record global divorce rates. According to recorded data, the marriage and divorce statistics are dramatically changing due to a number of poignant factors. Most common reasons include:

  • Incompatibility
  • Infidelity
  • Drug/alcohol addiction
  • Physical/mental abuse

The reasons are quite a lot, and we haven’t even mentioned other irreconcilable factors that cause couples to call it quits and end their marriage.

Even marriage rates have not been stable and are dropping. This, however, does not include figures of marriages that ended through legal separations.

Here’s a divorce rate map, with the list of countries with the highest divorce rate.

Luxembourg: 87%

With a population of approximately 500,000, Luxembourg is actually one of the smallest countries in Europe. It boasts an advanced economy and high purchasing power parity. It’s also one of the states in Europe with the highest population growth rate. And right now, it’s also the top country with the highest divorce rate in the world.

To ensure safe travel during the continued coronavirus pandemic, the EU has agreed on a common approach to free movement restrictions.

A traffic-light system to classify EU countries (EU 27 + Iceland, Liechtenstein, Norway and Switzerland) according to their epidemiological (rate of infection) situation has been put in place.

This information is available online providing travellers with the latest data and details on any restrictions and special rules in place (such as quarantine and testing requirements).

As some countries may have stricter rules, check here for more information on the specific rules that apply when travelling to Poland.

What are the rules to enter this country with or without the EU Digital COVID certificate from an EU Member State or Schengen Associated country?

Travellers can enter Poland without being subject to further restrictions (testing or quarantine), if their 'EU Digital COVID Certificate' (EUDCC) contains one of the following:

  • Proof of full vaccination, valid 14 days after the second dose of a vaccine with a two-dose schedule (counting from the day following the last vaccination date) or 14 days after the single dose of the Janssen/Johnson&Johnson vaccine. The vaccines approved by the European Medical Agency (EMA) are accepted.
  • Proof of recovery from COVID-19. Validity: 6 months  from the day of the positive result to a test.
  • A negative COVID-19 test result: both PCR and antigenic tests are accepted. Validity: 48 hours before arrival.
  • In the absence of a valid 'EU Digital COVID Certificate', other official documents in Polish or English, in electronic or paper form, are accepted if they certify one of the following:
  • Travellers who do not hold any of these documents are subject to a 10-day quarantine upon entry, regardless of the means of transport used (collective, individual, or when crossing the border on foot).
  • The 10-day quarantine may be shortened by a negative result to a COVID-19 test (PCR or antigen) performed in a laboratory – at own costs — within 48 hours after crossing the border.

_________

The EU Digital COVID Certificate Regulation entered into force on 01 July 2021. EU citizens and residents will now be able to have their Digital COVID Certificates issued and verified across the EU. National authorities are in charge of issuing the certificate.

The certificate provides a standardised recognition of the holder's status related to vaccination, recovery from Covid-19, or test result.

Despite the European Digital COVID Certificate, each country continues to be responsible for the definition of its own entry requirements and rules, which are not standardised at the EU level.

This means that what is required to enter upon presentation of this certificate, depends on the measures and entry rules in place at your destination.

Easy & cheap

My coworker recommended this service and I couldn’t be more thankful! Simple, fast and efficient!

I was very surprised to see they don’t charge extra for more kids. Paid, got my forms, and I’m divorced now. Very good value for such money.

Thought it was risky first, but a lawyer would just make me broke, so this was my only option. No regrets so far. My documents were accepted and I’m now waiting for the final hearing.

My ex-wife wanted to divorce me because I was poor. Had no other option but to break up with her. Guess what, I had no money to hire a lawyer, and this online divorce service saved me lots of headaches. Thanks

I did have a lot of doubts regarding online divorces. Decided to try and had no regrets so far

This is simply the best divorce preparation services website. Tried to order from another company first but support didnt even answer the phone

Took about 35 minutes to fill in my online divorce form and quite definitely not 20 minutes as promised. Support told me that I’m a mom of three with some property and debt to divide and it usually takes 20 minutes without kids or with 1 kid only. Good overall, but they could’ve said that from the very beginning.

I was on very tite budget and was looking for cheep do it yourself divorce forms. I received all needed, thanks you.

Heard about this web site from my friend. He said that he paid just 139 bucks and got all all divorce documents online. I gave it a try and it worked out. Hope to never use this service again though lol

Luckily, my ex-wife agreed to divide our property fairly and we could order the whole divorce packet online. Alice from the support team did a great job explaining things. Very good and quick divorce online

Fast delivery and I received a divorce paper form that was approved by the court. Everything went smooth as expected

Most probably the best divorce document preparation services website.

My ex-wife and me decided to order a DIY divorce kit. We were ready to end our marriage but had no money for the lawyer.

Found this website a motnh ago. Today finally decided to get divorced and purchased a divorce packet online. DOn’t know how much more would spend on the lawyers, but it definitely saved my money, thanks

Used this divorce applications form. Good job.

Just received my court divorce forms. Didn’t know that there would be so many docs to submit but they were all approved by thte court.

Online Divorce — Begin Your Divorce Without a Lawyer Today (2021)

Couples Can Untie the Knot Online; Divorce is a mouse click away, but not for everyone.

The Los Angeles Times; Los Angeles, Calif.; Nov 19, 2001; MARTIN MILLER;

Abstract: Californians can legally split from their spouses over the Web site online
and never have to set foot in a courthouse or lawyer's office. Legal papers can be completed
within anywhere from 30 minutes to
two hours, depending on the complexity of the split, according to Randolph Finney, a
Seattle-based family law attorney who
founded the site.

For Californians, once the judge signs the documents, they are «legally binding and enforceable,»
says Finney, but per state law the
divorce doesn't become finalized for six months.

The circle of online life is now complete. You can date online; you can marry online; and now you
can divorce online.

Californians can legally split from their spouses over the Web site online
and never have to set foot in a courthouse or lawyer's office. Legal papers can be completed within
anywhere from 30 minutes to two
hours, depending on the complexity of the split, according to Randolph Finney, a Seattle-based
family law attorney who founded the
site.

For a flat fee of $299, the site walks divorcing couples step-by-step through such issues as
community property and calculating
child support payments. When the online form is completed, the applicant simply signs the papers and
mails them to the
courthouse.

But it's not for everyone. It works only for those couples who are parting amicably and filing for
an uncontested divorce. «If you
can't agree on who gets the kids, our site is not for you,» says Finney, a married 35-year-old.

The site debuted earlier this year, but only to residents of Washington state. Last month,
California was added, and soon Florida,
New York and Oregon are expected to be added. So far, the site has helped process hundreds of
divorces, says Finney.

The site has drawn critics who denounce the online divorce as yet another blow to society's bedrock
institutions. The very ease of
the process, some contend, makes family and marriage as disposable as an old appliance. Indeed, a
similar site in England was
recently condemned by the pope as immoral because it made divorce too easy.

Naturally, Finney disagrees. «I think our Web site has the opposite effect,» he said. «If you're
going to get divorced, let's do it
in a civil manner. I really don't believe having something available that makes it easier and costs
less money is going to encourage
divorce.»

The inspiration for the project came from his law practice, where he primarily handles divorces. It
took about a year to get the
site up and running. «On almost a daily basis, I would get clients who said they needed a divorce
but didn't have the money or the
patience with the legal process to pursue it,» he said. «These people are really stuck between a
rock and a hard place.»

For Californians, once the judge signs the documents, they are «legally binding and enforceable,»
says Finney, but per state law the
divorce doesn't become finalized for six months. «It isn't quite as fast as a Las Vegas divorce,» he
says.
