The cost of services of state registration of a divorce through the registry office includes the state fee for filing a statement for divorce. It is paid by one of the spouses.

In addition, spouses can use a paid service for drawing up a statement for divorce in the State Register of Civil Status of Citizens.

The cost of services for divorce through the court implies legal costs – these are the actual monetary costs connected with appeal to the court for protection and organizing and providing of such a legal protection, the payment of which is carried out by the participants of the case, and if they are exempted from paying court costs – at the state’s expense.

The cost of court expenses consists of the court fee and costs associated with the consideration of the case with the participation of a lawyer.

The costs connected with the consideration of a divorce case with the participation of a lawyer include the costs:

  • on professional legal assistance of a lawyer;
  • connected with the involvement of witnesses, specialists, translators, experts, expert examination;
  • connected with the reclamation of evidences, inspection of evidences at the place of their location, provision of evidences;
  • connected with the commission of other procedural actions necessary for the consideration of the case or preparation for its consideration.

According to the Law of Ukraine On Court Fee, court fee is a fee levied throughout Ukraine for filing statements, claims in court, for issuing documents by courts, as well as in the case of certain court decisions provided for by this Law.

The court fee is included in court costs. The law establishes several ways of determining the court fee:

  • the court fee is levied in the corresponding amount of the subsistence minimum for able-bodied persons, in which the corresponding statement or claim is filed through the court;
  • as a percentage of the value of the claim;
  • fixed size.

The original receipt of the payment of the court fee is filed with the statement of claim.

The cost of services in case of divorce through the registry office consists of the payment of the state fee established by the Decree of the Cabinet of Ministers of Ukraine “On the state fee”.

The original receipt of  payment of the state fee is attached to the application for divorce. The receipt should be paid on the day the spouses apply for divorce.

What is the cost of services for divorce in Ukraine, price?

The cost of divorce services is calculated taking into account the professional legal assistance of a lawyer.

A lawyer is an individual who carries out advocacy on the grounds and in the manner prescribed by the Law of Ukraine “On the Bar and Advocate Activity” dated July 5, 2012. It is the lawyer who provides independent professional legal assistance on a contractual basis with the client.

An agreement on the provision of legal assistance is an agreement under which one party (a lawyer, a law office, a lawyer association) undertakes to defend, represent or provide other types of legal assistance to the other party (client) on the terms and in the manner specified by the agreement, and the client undertakes to pay provision of legal assistance and the actual costs required for the fulfilling of the contract.

The content of the agreement is determined by the parties, but it should necessarily contain:

  • full information about the parties;
  • subject of the contract;
  • rights and obligations of the parties;
  • type (or types) of lawyer services, their volume and cost.

Conditions and procedure for determining the cost of services involve:

  • terms and form of payment for services;
  • additional expenses;
  • preliminary (advance) payment and its amount: date of the conclusion of the contract and its period of validity;
  • signatures of the parties and other conditions agreed by the parties.

In 2018, the minimum subsistence level was raised, which caused a reciprocal increase in the cost of services and consumer goods. The amount of court fees was increased when filing a statement of claim in court. In addition, the cost of legal services has also increased. At the same time, the amount required for registration of a divorce largely depends on the method of its implementation.

How much does a divorce cost at the Civil Registry Office?

The decree of the Cabinet of Ministers of Ukraine “On State Duty” ruled that the cost of a divorce in the Civil Registry Office in 2018 is half of the NMDG, that is, 8 UAH 50 kopecks. Also, you will be required to pay for the information and technical services provided by the Civil Registry Office. The price of this service is different in each locality, but no more than a few dozen hryvnias.

The cost of divorce through court

In court, spouses who have not found a common language have to divorce. If the husband or wife does not consent to the dissolution of the marriage, then the initiator of the break in the right to unilaterally withdraw from the marriage relationship. Also, spouses who have joint children under 18 go to the judicial institution.

To divorce through the court, the plaintiff will need to collect a certain package of documents and draw up a statement of claim.

If everything is done independently, then for divorce you will need to pay only for a court fee in the amount of 704 UAH 80 kopecks. But not everyone can properly draw up a claim.

If you decide to file a divorce with your husband, then according to Ukrainian law, you must pay a state fee and / court fee.

The main documents regulating the amount of state fees and court fees in Ukraine are the decree of the Cabinet of Ministers of Ukraine “On state fees” and the Law of Ukraine “On court fees”.

In the event of divorce at the same time as the division of the spouses’ property, the cost of the state duty (court fee) will be determined, including taking into account the provisions of the Civil Procedure Code (CPC) of Ukraine.

The cost of the court fee (state fee) depends on the following factors:

  • divorce occurs in the registry office or in court;
  • there is a question of the division of property or not;
  • the value of the acquired property;
  • the problem of collecting alimony is being solved.

How much is the state fee for divorce in 2021 in Ukraine

The state duty is the amount of money collected, among other things, in the departments of state registration of acts of civil status, city, village, settlement councils.

That is, if the divorce procedure is carried out in the registry office, then in accordance with the decree of the Cabinet of Ministers of Ukraine “On State Duty”, each of the spouses is obliged to pay 0.

5 non-taxable minimum incomes of citizens, which in 2021 is equal to 7 hryvnia 50 kopecks.

In addition, in the registry office for a possible divorce and unilaterally, for example:

  • recognition of one of the spouses by the court as missing;
  • recognition of one of the spouses as incompetent by a court decision;
  • detention (imprisonment) of one of the spouses for a period exceeding 3 years.

In case of unilateral divorce in the registry office, the size of the state fee is 0.3 non-taxable minimum incomes of citizens, that is, as of 2021 – 51 kopecks.

In order for your divorce application to be considered, you must pay a court fee in advance.

How much is the court fee for divorce in 2021 in Ukraine

Court fee – a fee levied throughout Ukraine for filing applications, complaints to the court, for the issuance of documents by the courts, as well as in the case of certain court decisions provided for by this Law. The court fee is included in the court expenses (Law of Ukraine “On Court Fee”). The actual cost of the court fee is contained on the official portal https://court.gov.ua/affairs/sudytax/.

The size of a divorce in court is significantly different in its cost from the state fee. More often, married couples have to file a divorce in court. This procedure is mandatory in the following cases:

  • When the family has a common minor child (children);
  • When one of the spouses does not agree to a divorce;
  • If the spouses could not exactly agree on the division of property.

How much does a court divorce cost in 2021? The cost of the court fee will depend on whether the spouses will share the property acquired in marriage, carry out the “division of children”, raise the issue of collecting alimony, and there was a marriage contract between the spouses.

The easiest option is to file a claim without a property section. Under these circumstances, the amount of the court fee for 2021 will cost you UAH 908.

However, after a court decision is made, the spouses still need to contact the registry office to obtain a divorce certificate.

Each person will pay for its issuance separately.

How much is the court fee for divorce with division of property in 2021 in Ukraine?

The amount of the court fee is calculated in a completely different way if the claim contains a requirement to divide the property acquired in marriage, namely, the claim is worth 1% of the cost of the claim (monetary claim) but not less than 0.4 of the minimum subsistence level for migrant persons (size in 2021 – 908 hryvnia) and no more than 3 sizes of the subsistence minimum for able-bodied persons (Law of Ukraine “On court fees”).

Thus, if the spouses have not agreed on the division of property, the divorce process can incur significant costs, not counting the costs of legal fees, which often have to be used.

To avoid paying the court fee, you should not file a claim for the division of property upon divorce, since there are several options for concluding agreements between spouses, namely:

  1. division of property during marriage;
  2. property division agreement;
  3. prenuptial agreement (contract);

Therefore, in the event of a dispute between the spouses on the division of property, it is better to take preventive actions and try to agree with the aim of a fair distribution of jointly acquired property and respecting the interests of both parties.

What is the cost of family lawyers’ services in 2021 in Ukraine

In certain situations, you cannot do without the qualified help of specialists. After all, the desire to save money on the services of a lawyer and independently understand the norms of the law can cause additional costs and stress.

Assistance can, for example, be useful in preparing a statement of claim and submitting a package of documents to the court, in representing interests, in drafting and submitting petitions, in appealing against court decisions. Some law firms offer divorce management packages as well as comprehensive services such as turnkey divorce.

The cost of a lawyer’s services directly depends on the complexity of a particular situation, as well as on the timing and volume of his work.

  11. drawing up an agreement on the division of property between spouses – costs from 1000 hryvnia;
  12. one-time access to the court – from 1000 hryvnia;

If you are going to file a lawsuit for divorce, remember that you need to pay in advance. Otherwise it will not be accepted.

Please note that it will be much cheaper to part, having agreed on all the nuances with your wife or husband in advance. Sometimes not everyone is satisfied with the decision made by the court.

In this case, it is possible to file an appeal without paying a court fee. Also, the fee is not charged from the plaintiffs if they are disabled groups 1 and 2.

The crude divorce rate can give a general overview of marriage in an area, but it does not take people who cannot marry into account.

For example, it would include young children, who are clearly not of marriageable age in its sample. In a place with large numbers of children or single adults, the crude divorce rate can seem low.

In a place with few children and single adults, the crude divorce rate can seem high.
